Please read these rules (the “Tournament Rules”) before Participating in the Royalty Showdown Tournament (the “Tournament”). Participation in the Tournament constitutes participant’s full and unconditional agreement to and acceptance of these Tournament Rules. NO PURCHASE NECESSARY TO PARTICIPATE OR WIN. VOID WHERE PROHIBITED.
1. Eligibility.
a. You may participate in the Tournament if you are a natural person who is a legal resident of one of the following countries: United States, Argentina, Australia, Austria, Belarus, Belgium, Belize, Bolivia, Brazil, Bulgaria, Chile, Canada, China, Colombia, Costa Rica, Croatia, Denmark, Ecuador, El Salvador, Estonia, France, Finland, Germany, Greece, Guatemala, Honduras, Hong Kong, Hungary, Iceland, Ireland, Israel, Italy, Jamaica, Japan, Latvia, Lithuania, Luxembourg, Macau, Malaysia, Mexico, New Zealand, Nicaragua, Norway, Paraguay, Peru, Philippines, Poland, Portugal, Romania, Russia, Serbia, Singapore, Slovakia, South Africa, South Korea, Spain, Sweden, Switzerland, Taiwan, Thailand, The Czech Republic, The Netherlands, The People’s Republic Of China, Turkey, Ukraine, United Kingdom, Uruguay, Vietnam, or Venezuela.
b. To participate in the Tournament, you must be at least the age of majority in your country of residence as of October 17, 2018 – or – if you are under the legal age of majority in your country of residence, but at least 16 years old as of October 17, 2018, you must have your parent or legal guardian read and accept these Official Rules and sign any additional required documentation on your behalf, for example waivers or tax forms;
c. Employees of Daybreak Game Company LLC, NantG Mobile LLC, and their parent or subsidiary companies, or any other company involved in the design, implementation, or promotion of the Tournament, as well as the spouses, children, parents, grandparents, and household members of each such employee, are not eligible to play in the Tournament. The Tournament is subject to all applicable laws and regulations and is void where prohibited or restricted by law.
d. Players participating in the tournament must meet minimum requirements for their connection speed to the host tournament server, not to exceed ping of 150. Removal is the right and judgement of the tournament sponsor and judges.
2. Sponsor.
The Tournament is co-sponsored by Daybreak Game Company LLC, 15051 Avenue of Science, San Diego, CA 92128 and NantG Mobile, LLC, 9920 Jefferson Boulevard, Culver City, California 90232 (each a “Sponsor”).
3. Tournament Rules.
By participating in the Tournament, you warrant that you fully and unconditionally agree to and accept these Tournament Rules, as well as the H1Z1 Online End-User License Agreement, the Daybreak Terms of Service, and the Tournament Policies, each of which are incorporated herein by reference. You further warrant that you will accept the decisions of the Sponsor, which are final and binding. Winning is contingent upon fulfilling all requirements set forth herein and carefully reading all of the provisions of, agreeing to, and signing an affidavit of eligibility and liability/publicity release.
4. Qualification Instructions.
The Tournament consists of invited participants from each region playing the Sponsor game on PC, H1Z1 (the “Game”). All participants will be invited by Sponsor, via email, and must respond to the email to notify Sponsor that they accept the invitation. Seventy-Five (75) participants will be invited per region. There will be a Tournament for each region.
Sponsor shall have the right, but not the obligation, to select alternate participants to participate in the Tournament in case an invited participant is unable and/or unwilling to participate.
All participants must meet all eligibility requirements. Sponsor reserves the right to reject any Participant that it determines, in its sole discretion, does not meet the eligibility or qualification instructions.
5. Participating in the Tournament.
a. Check-In – In order to participate in the Tournament, each confirmed participant must report to their respective hosted games server fifteen (15) minutes prior to the start of their match. In addition to complying with these Tournament Rules, participants will be required to comply with the Tournament Policies, and the Tournament Official’s instructions and decisions throughout the Tournament. Please be aware that the Tournament Policies include the requirement that participants have an adequate connection speed (not to exceed a ping of 150ms) to the host tournament server in order to protect the integrity of tournament gameplay. Participants understand, acknowledge and agree that by participating they are pitting their skills in a H1Z1 match against those of others in their region. Participants understand, acknowledge and agree that the Game matches are determined by the skill of the participants and that luck or chance plays a negligible role in the outcome of the event.
b. Tournament – The Tournament will take place from October 17, 2018 –October 19, 2018. Each region’s Tournament will consist of three (3) separate H1Z1 matches of approximately 75 people. Each Game match is scored in accordance with the current Game scoring. Points from each Game are totaled and the players’ overall performance is based on the total score of all matches. The total scores shall determine the winner(s) of each region’s Tournament and prizes will be awarded according to the prizing section below. The Tournament Official’s determinations and decisions regarding the gameplay in each match shall be binding and final.
c. Judging Criteria - The winners in each region’s Tournament are determined by player with the most total points after three (3) rounds of play. Each Game match is scored in accordance to the current Game scoring. All prize winners will be announced on the Game website. If there is a tie based on point totals, it shall be broken in the following manner and order, as applicable: 1. more kills in total from the Tournament matches, 2. more kills in the first Tournament match, 3. more kills in the second Tournament match, 4. the earlier kill in the third Tournament match.
6. Tournament Match Times (Players are responsible for converting the date and time according to their region pf participation).
ALL PLAYERS ARE RESPONSIBLE TO SHOW UP FOR THEIR RESPECTIVE GAMES 15 MINUTES PRIOR TO THE MATCH START TIME.

7. PRIZES.
a. The winner in each of the South America, Europe, Australia, and Asia Pacific region Tournaments will receive the exclusive, tradeable 2018 GOLD SHOWDOWN SHOTGUN (US$0.00 ARV).
b. The top 10 winners from each region’s Tournament will receive the 2018 GOLD SHOWDOWN AR-15 (US$0.00 ARV). The top 10 winners of each region will also be determined according to Section 5(b) of these Tournament Rules.
Prizes are not transferable or refundable and must be accepted as awarded. No other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize (or component thereof) with another prize (or component thereof) of equal or greater value in the event that a prize is unavailable as determined by the Sponsor in its sole discretion. Taxes, including VAT taxes, and all other expenses and costs not expressly listed above are the winner’s responsibility. Each winner will be required to carefully read all of the provisions of, agree to and sign an affidavit of eligibility and liability/publicity release, and in some cases, will be required to fill out an IRS form W-8 or W-9, to be eligible to win a prize. Failure to sign the affidavit and release or to fill out the tax forms will result in forfeiture of the prize.
8. Privacy.
All information submitted as part of the Tournament will be treated in accordance with the Sponsor’s Privacy Policy.
9. Requirements of Winner.
By agreeing to become a winner and/or accepting or using a prize, the selected Participant: (i) is required to sign and return an affidavits of release, release of liability, declaration of eligibility, an IRS W-9 form and/or where lawful, publicity consent agreements, within five (5) days of acknowledged notification; and (ii) agrees to the use of his or her name, voice and/or likeness, and submitted content, for the purpose of advertising, trade, marketing, or promotion by Sponsor without further compensation, unless prohibited by law. If a selected potential winner cannot be contacted, is ineligible (under these rules or due to a failure to comply with any of the other applicable policies, licenses, rules, and terms of service), or fails to timely return the completed and executed releases/agreements as required, the prize may be forfeited and an alternate potential winner may, at Sponsor’s discretion, be selected. 10. General Conditions.
10. General Terms and Conditions.
By participating in the Tournament, Participant agrees that under no circumstances, including, but not limited to, negligence, shall Sponsor, its officers, directors, employees, shareholders, agents, successors, and assigns (the “Released Parties”) be liable for any direct, indirect, incidental, special, or consequential damages arising out participation in the Tournament, including without limitation anything associated with the prizes, even if any or all of the Released Parties have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, and therefore such exclusions may not apply to you. By participating in the Tournament, Participant waives any and all rights to bring any claim or action related to his/her participation in any forum beyond one (1) year after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based. By Participating, Participant agrees to be bound by these Tournament Rules and the decisions of Sponsor, which shall be final. Sponsor reserves the right to disqualify any person, entry, or e-mail address that Sponsor determines to be in violation of any term contained in these Tournament Rules. Sponsor, its parent companies, affiliates, subsidiaries, licensors, advertising, promotion, and fulfillment agencies, legal advisors, prize providers, and the respective employees, officers, directors, shareholders, agents, and representatives of each, are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, stolen, incomplete, illegible, unintelligible or postage-due entries, notices, releases, forms, affidavits, or other correspondence; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, interruptions or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Tournament to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result from participation in the Tournament or arising from the Participant’s access to and use of any Daybreak internet site (or social media page run by Sponsor), including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, to the extent permitted by law; or (vi) any errors in any materials associated with the Tournament. Sponsor reserves the right to cancel, suspend and/or modify the Tournament if any problem corrupts the administration, security, or operation of the Tournament, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Tournament or to be acting in violation of these Tournament Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Tournament may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Tournament Rules shall not constitute a waiver of that provision.
11. Disputes.
The Tournament is governed by the laws of the United States and the State of California. As a condition of participating in the Tournament, Participant agrees that any and all actions or proceedings related to the Tournament shall be exclusively brought in the County of San Diego, State of California (if under state law) or the Southern District of California (if under Federal law), and the parties agree not to raise in connection therewith, and hereby waive, any defenses based upon the venue, the inconvenience of the forum, the lack of personal jurisdiction, the sufficiency of service of process or the like in any such action or suit brought in the State of California.
12. Tournament Results.
A winner’s list will be posted on the H1Z1 website or an underlying page thereto, at the conclusion of the Tournament. To obtain a copy of the winner list or a copy of these Tournament Rules, send your request along with a stamped, self-addressed envelope to: Attn: Marketing Department “Showdown 2018,” Daybreak Game Company LLC, 15051 Avenue of Science, San Diego, CA 92128. Requests must be received by December 31, 2018.

2. Tournament Information

2.1. Tournament Structure
Seventy-Five (75) contestants shall be invited to the Royalty Showdown. 2.3. Scoring
It is the player’s responsibility to stay up-to-date on the current scoring model, which may be updated at any point prior to the start of the match.
Solo Scoring:
Solo matches will use the following scoring model. Overall score per match combines points for placement and kills, and the player with the highest score receives 1st place, the player with the lowest score receives 100th place.
If there is a tie based on most kills per match, it shall be broken in the following manner: 1. The person who made the earlier kill in the match wins.

2.4. Pre-Match Procedures
Players are expected to be ready and in their respected servers fifteen (15) minutes prior to the start time of each match. If players are experiencing any technical issues they should contact customer service immediately.
2.5. Technical Issues
Technical issues impacting more than one player will be at the discretion of the Tournament Official to warrant a match restart.
Restarting a match is a discretionary decision of the Tournament Official, based on his or her best judgment to conduct a fair event for all players. All players entering into the H1Z1 Royalty Showdown should know that there are bugs that may impact a player’s game experience. Bugs experienced by a single player may not warrant a match restart, and the match will instead continue.
All players participating in the Showdown Tournament must be able to maintain a competitive "ping" connection of 150 or less. Failure to do so can result in removal from the Showdown event. This is up to the event organizers and judges to determine.

2.6. End of Game Procedures
Upon being eliminated from the match, players should exit the tournament server and should be ready to join the next match when it becomes available. Players eliminated from a match are not allowed to interact with players still remaining in the match. Once the match has concluded all players should be queuing into the next match.
Upon conclusion of the tournament, any players expected to earn a prize are required to fill out the appropriate tax form and waiver. Players who fail to fill out the appropriate paperwork will be ineligible for prizing.
2.7. Cheating
Players are not allowed to team with other players, or attempt to collude.
Players are not allowed to use exploits to gain advantage in the match.
Voice chat will not be allowed in-game for the Solo Tournament.
If the Event Official determines that a player is cheating, that player will be removed from the event and is ineligible for prizes.
2.7.1. Outside Assistance
Players may not receive outside assistance regarding the location of other players, other players’ health or equipment, or any other information not otherwise known to the player. Players are therefore also not allowed to provide another player with outside assistance.
If the Tournament Official determines that a player has received outside assistance, or provides another player with outside assistance, that player will be removed from the event and ineligible for prizing.
2.8. Unbecoming or Unsportsmanlike Conduct
Players are expected to conduct themselves in accordance with the End User License Agreement, Daybreak Terms of Service, H1Z1 Royalty Showdown Tournament Policy. At any time, if a player behaves in anyway determined by the Tournament Official as unbecoming, the Tournament Official may remove the player and that player would be ineligible for prizes.
3. Responsibilities

The Tournament Official is there to ensure an on-time and fair tournament. Players are expected to follow instructions by the Tournament Official at all times. Application of the Tournament Policy is at the judgment of the Tournament Official and must be observed by all players participating in the event. The Tournament Official will have final determination on cheating, unbecoming conduct, and event operations as they pertains to a player’s ability to participate in the event or to be eligible for prizes. Players are allowed to escalate event decisions to the Tournament Official, but his or her determination is final.
