H1Z1 Showdown Server Policy

Qualification Period

Servers: The servers for the H1Z1 Showdown qualification period are private servers captained by identified individuals (“Captains”) and hosted by Daybreak where players (upon being granted an access key by the Captain) may play rounds of H1Z1 Battle Royale (“Game”). Participating on the Servers, in any capacity, is pursuant to Daybreak’s Terms of Service and the H1Z1 End User License Agreement.

Access: The Game is an "online" game that must be played over the Internet. Daybreak reserves the right to interrupt, modify (including adding or removing servers), suspend, cancel or terminate the Game or access to the Server(s) with or without prior notice for any reason or no reason. You agree that neither Daybreak nor its licensors will be liable for any interruption, delay or failure of the Game or Servers to perform, and you understand that you shall not be entitled to any refund of fees or compensation for interruption to your use of the Game and/or Servers or any failure of the Game and/or Servers to perform. Daybreak has the right at any time for any reason or no reason to change and/or terminate any aspect of the Showdown, Servers, and/or the Game as it sees fit in its sole discretion.

Server Gameplay:

Captains -

  1. Captains must invite players to participate on their Servers in an equitable and inclusive manner
  2. Captains must distribute the access keys for free
  3. Gameplay must be structured in a fair manner pursuant to the EULA and the Battle Royale ruleset. Captains must report to Daybreak any players suspected of cheating.
  4. Daybreak shall have the right to terminate the Captain’s access if Daybreak determines in its sole discretion, that, except in order to provide an honest and unbiased critique of the Game, the Captain has committed any act or has been involved in any situation or occurrence which brings Captain or Daybreak into public disrepute, contempt, scandal or ridicule, shocks, insults or offends the public or any class or group thereof, or reflects unfavorably upon Daybreak’s reputation.

In General -

  1. To play on a Server, you must have a Daybreak account in good standing and have purchased early access to H1Z1.
  2. By logging into a Server, you consent to your gameplay being recorded and broadcast. You consent to and authorize the use of your character name, voice, likeness, and sound recordings, by the Captain and/or Daybreak in any manner or media whatsoever, now known or hereafter devised, on a worldwide, perpetual, royalty-free basis.
  3. No questionable content is allowed on the Servers or in promotional content in connection with the Servers. You shall not a. infringe any intellectual property, proprietary, publicity/privacy and/or other rights of any third party(ies), b. violate any law or regulation, c. be defamatory, profane, obscene, pornographic, or harmful to minors, or d. violate Daybreak’s Terms of Service.
  4. No pornography, gambling, contests with prizing, or any content incompatible with Daybreak’s business (e.g. gold farming, hacking, cheating)
  5. No unsportsmanlike behavior

Reporting: Captains will determine their teams through player performance and community contribution. Daybreak may report to Captains, by character name, any stand-out players who play on a Server.

License: Daybreak grants Captains a limited, non-exclusive, revocable, non-transferable license to create and distribute images, artwork, articles, and videos that contain or are based on in-game events, screenshots, and game play footage from Daybreak games ("Content"). Your Content, and your use of the Content, are subject to and must comply with Daybreak's Terms of Service. You may use such Content only for non-commercial purposes, except that videos may be monetized through "partner programs" on sites like Twitch and YouTube. You may not use, sell, distribute, license or otherwise exploit any Daybreak game content or intellectual property for any other purpose or in any other manner other than as expressly provided in this Policy and the Terms of Service. Daybreak reserves the right to require the removal and/or deletion of any Content that does not comply with this Policy and the Terms of Service.

H1Z1 Showdown 2015 Tournament Official Rules

Please read these official rules (these “Official Rules”) before entering the H1Z1® Showdown 2015 Tournament (the “Tournament”).

1. Eligibility: The Tournament is open only to natural persons who are at least the age of majority in their country of residence at the time of entry and have a Daybreak account in good standing with early access to Daybreak’s game H1Z1 and the Battle Royale game mode. Employees of Daybreak Game Company LLC, its parent or subsidiary companies, or any other company involved in the design, implementation, or promotion of the Tournament, as well as the spouses, children, parents, grandparents, and household members of each such employee, are not eligible. The Tournament is subject to all applicable laws and regulations and is void where prohibited by law. No purchase necessary to enter.

2. Sponsor: The Tournament is sponsored by Daybreak Game Company LLC, 15051 Avenue of Science, San Diego, CA 92128 (the “Sponsor”).


3. Agreement to Rules: By participating in the Tournament, each entrant warrants that he/she fully and unconditionally agrees to and accepts these Official Rules, as well as the H1Z1 Online End-User License Agreement, the Daybreak Terms of Service, and the Showdown Policies, each of which are incorporated herein by reference. Each entrant further warrants that he/she will accept the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein and carefully reading all of the provisions of, agreeing to and signing an affidavit of eligibility and liability/publicity release.

4. Tournament Qualification:

Invited Participants – The Tournament is an invitational tournament. Sponsor and/or a server captain identified on the Showdown website (“Server Captain”) will contact all invited participants. Each invited participant must enter as an individual and shall meet the eligibility requirements for entrance stated in Section 1 above and meet the other rules and requirements set forth by Sponsor. Sponsor shall have the right, but not the obligation, to select alternate contestants to participate in the Tournament in case an invited participant is unable and/or unwilling to participate.

Approximately 75 players will be invited to participate in the Showdown. Each Server Captain’s team (five teams total) will consist of approximately (i) up to 12 players chosen from their private Showdown server (including themselves), and (ii) a certain number of public server players. Daybreak will identify and invite H1Z1 Battle Royale players from public servers to participate, based on gameplay criteria determined by Daybreak, and make such players (up to and approximately 15) available to be drafted by the Server Captains, and such public server players will therefore compete on behalf of that Server Captain’s team.

Draft:
On December 11, 2015, Server Captains will draft players for their teams from available public server players identified and invited by Daybreak to participate. Public server players shall be made available for the draft in increments of five (5) so that they may be drafted evenly to each team. The draft will occur in “straight draft” format, meaning selection will occur as follows until all available players are selected.

5. Competing in the Tournament:

Naming Requirements: Participants must submit to Daybreak their proposed names for the match by December 9, 2015. Names must include an abbreviation for the team name and then their handle. Daybreak may require certain players to use their known aliases to avoid confusion for spectators.

Check-In: In order to participate in the Tournament, each confirmed participant must be logged in and in-game on the designated server by 11:30 AM (PST) on December 12, 2015. Before the Tournament begins, the Tournament Official will review the rules of the Tournament with the participants, allow time for setting up equipment, and any other set-up instructions. In addition to complying with these Official Rules for the Tournament, participants will be required to comply with the Tournament Official’s instructions and decisions throughout the Tournament. Participants understand, acknowledge and agree that by participating they are pitting their skills in a H1Z1 Battle Royale match against those of others. Participants understand, acknowledge and agree that the Battle Royale matches are determined by the skill of the participants and that luck or chance plays a negligible role in the outcome of the event.


Start: The Tournament is scheduled to start at 12:00 PM PST on December 12, 2015.

Format: The Tournament will consist of four (4) separate H1Z1 Battle Royale matches of approximately 75 people. In each battle, the finishing order determines each player’s points, where the first place finisher (last contestant alive) receives points for the number of participants in the match (75 points in a 75 person match, 70 points in a 70 person match), second place finisher (second to last contestant alive) receives one less point and so on to the last place finisher who receives one point. After all four (4) matches, the points for each player will be tallied. The cumulative point score determines the winner(s). In the event of a tie for First Place, Daybreak will break the tie using the number of kills accumulated during the four matches. In the event of a tie for any other placement, Daybreak will award prizing to each of the players in that placement.

The Server Captain(s) with the most accumulated points from their designated team wins a Server Captain Prize. While the contestants are on a Server Captain’s team in order to determine which Server Captain wins the Server Captain prize, the Tournament is still a “last man standing” tournament. Cheating, such as using known exploits or third party programs, will not be tolerated. However, Daybreak will not be regulating teaming. The Tournament Official’s determinations and decisions regarding the gameplay in each battle shall be binding and final.

All prize winners will be announced on the H1Z1 website.

6. PRIZES: The First through Tenth Place winners based on the accumulation of points during all four matches, will receive the following prize:

The First Place prize is: (a) design input for a future H1Z1 crate skin, (b) a gold AR15 Showdown Skin (in-game), and (c) identify an eligible charity (as defined below) to which Daybreak will directly donate US$5,000. The “Top 10” prize for Second through Tenth Place is: (b) a gold AR15 Showdown Skin (in-game). The Server Captain Prize is the opportunity to give design input on an in-game sign, billboard, or statue. All players who participate, regardless of their placement, will receive an in-game Showdown participation shirt skin. The total retail value of all prizes is 0$. Prizes are not transferable or refundable and must be accepted as awarded. No other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize (or component thereof) with another prize (or component thereof) of equal or greater value in the event that a prize is unavailable as determined by the Sponsor in its sole discretion.

Eligible Charities: In order to be eligible to be chosen as a charity benefitting from Daybreak’s donation, the charity must be a well-established U.S. charity in good standing with no existing conflict of interest between any of the parties, as determined by Daybreak in its sole discretion. The charity must be registered under (i) the 501(c)(3) tax code and (ii) any jurisdiction where such registration is required as a charitable organization.


7. Privacy: All information submitted as part of the Tournament will be treated in accordance with the Sponsor’s Privacy Policy.

8. Publicity: Except where prohibited, participation in the Tournament constitutes each entrant’s consent to the Sponsor’s use of the entrant’s name, likeness, biographical information, and city and state of residence for promotional purposes in any media without further payment or consideration. By participating, each participant and contestant hereby perpetually and forever grants and releases to the Sponsor all rights of publicity (at common law and as set forth in California Civil Code Section 3344 or any other applicable law similar in name) and copyright rights in the participant’s name, voice, likeness, photograph, persona, signature, image, and performance for use in connection with the advertising, promotion, publicity, or other public use desired by Sponsor in any medium or transmission method and Sponsor may license or sublicense such rights to any person or entity as Sponsor desires.

9. General Conditions: In the event that the operation, security, or administration of the Tournament is impaired in any way for any reason, including, but not limited to fraud, virus, computer, software, network error, technical problems or other causes beyond Sponsor’s control which affect the administration, security, or integrity of the Tournament, the Sponsor may, in its sole discretion, suspend or modify the Tournament or these Official Rules to address the impairment and then, if practicable, resume the Tournament in a manner that best conforms to the spirit of these Official Rules, or cancel or terminate the Tournament without awarding any prizes if Sponsor determines in good faith that the Tournament cannot be continued due to circumstances that are out of its control. Tournament participants must play the game to the best of their ability at all times. Cheating will not be tolerated. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Tournament or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Tournament may violate applicable law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10. Release and Limitations of Liability: By participating in the Tournament, each entrant agrees to release and hold harmless the Sponsor, its affiliates, and their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim, demands, losses, damages, suits, debts, promises, liabilities, obligations, liens, costs, expenses, attorneys’ fees, indemnities, subrogations, duties or cause of action (whether known or unknown or accrued nor not yet accrued, anticipated or unanticipated) arising out of participation in the Tournament, any publicity flowing from the Tournament, any dispute regarding the outcome of the Tournament, any decisions of the Tournament Official, any disputes between entrants or participants, or receipt or use of any prize, including, but not limited to of the following: (a) unauthorized human intervention in the Tournament; (b) computer, software, or network errors; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Tournament or the processing of entries; (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Tournament or receipt of any prize; (g) injury or damage to reputation; or (h) any other claims that may be asserted against any of the Released Parties. Entrant further agrees that to the extent any claims have not been waived by the entrant or participant, in any remaining cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Tournament, and in no event shall the Released Parties be liable for attorney’s fees. Each entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

11. Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Tournament or any prize awarded shall be resolved individually, without resort to any form of class action. Any and all disputes arising out of or related in any way to the Tournament shall be governed by the laws and judicial decisions of the State of California (as permitted by Section 1646.5 of the California Civil Code or any similar successor provision), without giving effect to any choice of law rule that would cause the application of the laws of any jurisdiction other than the internal laws of the State of California to any such disputes. You expressly agree that any action at law or in equity arising out of or related in any way to the Tournament shall be filed only in the courts of the State of California for the County of San Diego, or the United States District Court for the Southern District of California. You hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

12. Tournament Results: Tournament winners will be listed on the H1Z1 Showdown website or send a self-addressed stamped envelope to Daybreak Games: H1Z1 Showdown Tournament, 15051 Avenue of Science, San Diego, CA 92128. Requests must be received by March 31, 2016.
